A Roundtable Discussion on the Functioning of the Automated System "Bankruptcy and Insolvency" Took Place

On 14 April, a roundtable discussion regarding the Automated System “Bankruptcy and Insolvency. Status of Trial Operation and Functional Improvement” took place. The event was organised by EU Project Pravo-Justice together with the Ministry of Justice of Ukraine. Representatives of the Directorate for Digital Development, Digital Transformation and Digitalisation of the Ministry of Justice of Ukraine and structural units and territorial offices of the Ministry of Justice, the State Enterprise “National Information Systems”, the Ukrainian National Insolvency Trustees Association, UNITA regional councils and insolvency trustees participated in the discussion.

Viktoriia Vasylchuk, Deputy Minister of Justice of Ukraine, noted that the Automated System “Bankruptcy and Insolvency” was put into trial operation on 1 June 2024. According to her, the 10-month period is enough to analyse system performance, identify technical and organisational challenges, and develop an action plan to improve it.

“The Automated System ‘Bankruptcy and Insolvency’ is a complex digital platform comprising electronic registers and personal accounts for insolvency officers. We aim to ensure that it not only complies with the law, but is also user-friendly in everyday operation. That is why we have organised this roundtable: to work together on further steps to improve the system functionality and increase its efficiency,” said Viktoriia Vasylchuk.

Iryna Zharonkina, Enforcement and Protection of Property Rights Component Lead, emphasised that implementing the Automated System “Bankruptcy and Insolvency” is not only a requirement under national law, but is also an essential element of Ukrainian integration into the EU. In particular, it concerns the implementation of Regulation (EU) 2015/848, which prescribes requirements regarding the functioning of insolvency registers and their interaction.

“The development and launch of the ASBI and its integration into other state registers – both in Ukraine and at the EU level – are key to the comprehensive collection, systematisation and analysis of data in the field of bankruptcy. This is an essential step to ensure transparent procedures and increase trust to the system and its effective functioning,” said Iryna Zharonkina.

In his turn, Vladyslav Filatov, Director of the Bankruptcy Directorate of the Ministry of Justice, said that in recent months, the Ministry has been actively working with the proposals from the professional community on regulatory improvements related to bankruptcy trustees’ reporting and ASBI functionality.

“We have received many suggestions from bankruptcy trustees and their councils on improving the reporting process. These recommendations were used as the basis for the updated version of the regulatory amendments concerning the reporting procedure, particularly the deadlines, format and frequency of submission,” said Vladyslav Filatov.

Furthermore, he stressed that reporting through ASBI is not just a mere formality but a requirement of the Bankruptcy Code of Ukraine, and it is critical for monitoring the country’s economic stability. Vladyslav Filatov noted that reliable and timely reporting allows the Ministry of Justice to assess the efficiency of bankruptcy procedures and, accordingly, influence macroeconomic indicators in wartime.

Oleksandr Bondarchuk, the Chair of the UNITA, emphasised that the Association regularly liaises with the Ministry of Justice to improve approaches to reporting.

“The purpose of our proposals is to make reporting more rational, convenient and end-user-oriented. I have no doubt that constructive dialogue and collaboration will help us make ASBI a truly effective and modern tool that will assist every bankruptcy trustee in their daily professional activities,” said Oleksandr Bondarchuk.

The participants also discussed the technical aspects of reporting – filling out forms, deadlines, uploading documents in PDF format, and proposals on simplifying certain procedures during the roundtable event.
